Alain Locke’s theory of value and functional equivalence is placed within more recent formalizations of functional analysis, recursion, and composition toward the study of sociocultural and political formation. With these resources in hand, Locke’s theory is proved to be one undergirding and integral to current studies of diaspora and sociocultural analysis.

In multiple essays, CLR James lays out what a theory of subjectivity must account for to resolve issues stemming from reducing subjectivity to a singular identity. Most proposals for a theory of subjectivity do so by making the subject the object of another’s propositions or claims about the world. I argue that this is an identity claim. The converse of this process is also true, that the subject who claims another as the object of their proposition must also be the (...) object of a proposition themselves, leaving the capacity to form these expressions untouched. In Black Cultural studies, there has been a lot of attention paid to the capacity for one to become the object of their own propositions due to the conception that Black identity overdetermines Black subjects’ expressions prior to their articulation. Our reorientation to the study of subjectivity posits an entity whose operation functions to mobilise as well as implement identity claims. Subjectivity is a capacity while identity becomes the object of that capacity, an object shared between subjects that are known by becoming the object of propositions regarding the world, including their own. This essay attempts to resolve the conflicts that arise once the mistake of conflating subjectivity with identity claims is made and proposes a model whereby the concept of Black subjectivity can be explained. When speaking of a form of life, we consider one different from others by way of its mode of expression, that is, by (...) its means of construction. This interpretation lends itself to a functional analysis of the material put to use and whose operations jointly express the concept we are after. Modes of expression can be plotted between a rhetorical and semantic axis (Gates 48). As such, "[t]he level of connotation of the visual sign, of its contextual reference and positioning in different discursive fields of meaning and association, is the point where already coded signs intersect with the deep semantic codes of a culture and take on additional more active ideological dimensions" (Hall 56). Coordinates within this domain encode signifying practices, revitalizing the traditional concept of signification as a function of what's signified with respect to a signifier. The content of a syntagm in this coordinate system, a point in this plane, indexes its function with respect to others. As such, we will conceive of the content of modes of expression functionally.A function is defined by pairing an element from a domain and another from a sub/co-domain whereby that pair is an element of that function. In this way, we can treat functions as abstract objects. If we treat a domain as what determines the availability of an expression, and a sub/co-domain as representative of its range of application, then the function of applying some proposition maps a movement from a domain of selection to one of composition, that is, its use with respect to others. The function of an expression, then, represents an operation over the possible worlds of its appropriate application (Taylor 201–02, 269, 276). Let this ensemble of functions be called an endowment.There is a pervasive debate in cultural studies that obsesses over proprietary notions as well as the ability to locate an origin. With that in mind, let us consider a coordinate system where there are two perpendicular axes, and we define positions within the space provided at the intersection of lines drawn from each. Each axis is represented by an ordered series of markers. A line drawn from each axis indicates that the coordinates indexed at their intersection is a function of these two markers. This locates an individual at a point in that domain, indexing a relation between the axes framing that space. Therefore, that coordinate-wise space, here a domain of possible expression, is not "empty" as pessimists would claim, but is filled with functional-content, albeit functions yet applied and marked by a point in that plane.Although we are currently speaking of two-dimensional space, the same follows for as many dimensions as we want. This essay discusses a core tenet of pessimism, Afropessimism, in particular. Pessimism claims to be a metatheory analyzing the assumptive logics of the system it critiques. Afropessimists hold that a logical treatment of pessimism is unwarranted because pessimism does not employ a logical treatment of its object. We’ll discuss Afropessimism and, by extension, pessimism, in general, on their own terms as metatheory. We’ll see that a metatheory indirectly follows the logic its object follows directly. From this, a metatheory must hold (...) an assumptive logic of its own, even if superficially disavowed. Consequently, we’ll arrive at a puzzling result when, in this particular case, the metatheory’s claims empty its object of its content, hence the pessimism. (shrink)

The Afro-Pessimist contends the impossibility of building a movement from “absolutely nothing.” This assumption comes from a misreading of Franz Fanon’s proposition in Black Skin, White Masks, “The Negro is not. Any more than the white man.” This paper analyzes the structure of Fanon’s proposition by considering ‘not’ as an operator while challenging and setting limits to the function of Identity utilized by the Pessimist. The way in which Fanon puts to use the elements of his proposition functions as that (...) statement’s meaning, rather than assuming a dictionary definition for each word whose sum presupposes a definition of the sentence. Where the Afro-Pessimist treats the period in Fanon’s assertion as a full stop, intending Black Identity’s interchangeability with “absolutely nothing,” I take the logical structure of Fanon’s assertion as a conditional, illustrating the fallacy inherent to the Pessimist position. In all, the structure of a proposition begets its expressive capacity. (shrink)

This paper shows the relevance of findings from studying the logic of self-referential statements to Cultural studies, Black Cultural Studies in particular. Results following from the incompleteness of the systems in which these statements are quantified help to clear up a paradox stemming from current Afropessimist discourse.

The present article was partly inspired by G. Pollack’s book, and also Dadoloff, Saxena & Jensen (2010). As a senior physicist colleague and our friend, Robert N. Boyd, wrote in a journal (JCFA, Vol. 1, No. 2, 2022), for example, things and Beings can travel between Universes, intentionally or unintentionally [4]. In this short remark, we revisit and offer short remark to Neil Boyd’s ideas and trying to connect them with geometry of musical chords as presented by D. Tymoczko and (...) others, then to Escherian staircase and then to Jacob’s ladder which seems to pointto possibility to interpret Jacob’s vision as described in the ancient book of Genesis as interdimensional staircase, e.g. an interdimensional bridge between heaven and earth (cf. classic book: Hofstadter, Godel, Escher, Bach). Jacob’s vision of angels going down to earth from that staircase has been depicted for instance in William Blake art etc. In our communication with others via physics literature and discussions etc, we came to several conclusions as follows: Firstly, possibility of wormhole effect to mirror particle universe, which sometimes it is termed non-orientable wormhole. While such mirror particles effect have been more than 50 years predicted with the so-called parity violation (cf. Lee & Yang, 1950s), and that is called symmetry breaking. Secondly, a series of extended experiments on laser irradiated cold water may suggest possible transition from a phase of water to be at least partially fourth phase of water, which may be composed of crystalline water (see e.g. Gerald Pollack, and also Harold Aspden on liquid crystalline). If we can imagine laser cooling effect can be done in protracted time, then we can achieve a physical representation of Aspden‘s liquid crystalline. Therefore, in this article we outline a series of simple experiments of laser irradiated iced-water along with beryl and selenite crystals in order to see possibility of such a quantum tunneling via quantum liquid crystalline Universe hypothesis, which may likely be modeled with iced-water. It is interesting to remark here that certain experiments by Stockholm University scientists have shown that X-ray triggered water can exhibit properties just like liquid crystal (cf. PRL, 2020). That is why we consider it possible that there can be quantum phase transition where liquid water (comprised of iced cubes and water) can exhibit effects such as tunneling in quantum liquid crystalline Universe. Australia II became the first foreign yacht to win the America's Cup in 1983. The boat had a revolutionary wing keel and a better underwater hull form. In official documents, Ben Lexcen is credited with the design. He is also listed as the sole inventor of the wing keel in a patent application submitted on February 5, 1982. However, as reported in _New York Times_, _Sydney Morning Herald_, and _Professional Boatbuilder_, the wing keel was in fact designed by engineer Peter (...) van Oossanen at the Netherlands Ship Model Basin in Wageningen, assisted by Dr. Joop Slooff at the National Aerospace Laboratory in Amsterdam. Based on telexes, letters, drawings, and other documents preserved in his personal archive, this paper presents van Oossanen’s account of how the revolutionary wing keel was designed. This is followed by an ethical analysis by Martin Peterson, in which he applies the American NSPE and Dutch KIVI codes of ethics to the information provided by van Oossanen. The NSPE and KIVI codes give conflicting advice about the case, and it is not obvious which document is most relevant. This impasse is resolved by applying a method of applied ethics in which similarity-based reasoning is extended to cases that are not fully similar. The key idea, presented in Peterson’s book _The Ethics of Technology_ (Peterson, The ethics of technology: A geometric analysis of five moral principles, Oxford University Press, 2017), is to use moral paradigm cases as reference points for constructing a “moral map”. Sometimes Strauss argues as if he thought it possible to understand man without raising questions about his relations to other things, and hence about his place in the whole. But when they are viewed in their broader context, such arguments are seen not to be his final word. Man's humanity cannot be understood in its own terms alone. The human soul differs from everything else in that it is "... open to the whole and therefore more akin to the whole (...) than anything else is." In ordinary usage, "whole" implies completeness and autonomy. But the openness of the soul--i.e., of a part--to the whole can only mean that the whole is open to itself. The whole is, then, not, in the ordinary sense of the term, whole. Nor is the soul which is "open" to it. Stripped of myths, "... the human soul is... more akin to the whole than anything else is" because neither of them is whole. The same conclusion follows when one tries to understand the definition of the philosopher as the man animated by quest for knowledge of the whole. Qua philosopher he knows neither that there is a whole, nor what it might be if there were one. To define the philosopher as the man who knows that he does not know only paraphrases the difficulty. It does not solve it. For "know" is here used equivocally. The same equivocation is at play in the comment "... one cannot know that one does not know without knowing what one does not know". Admittedly "knowledge of ignorance is not ignorance." The philosopher believes and perhaps divines more than he actually knows. All men do. The essential difference between the philosopher and other men may well consist in the fact that the philosopher distinguishes more conscientiously than do others between what he knows and what he believes, and that he strives more single-mindedly than do they to transform as large a share of his beliefs as possible into knowledge. He may conceivably at some point be said to have reached the stage where his aspirations have become reasoned expectations. But that is as far as he can possibly go as long as he remains a philosopher and has not become a wise man or a god. Until and unless the philosopher knows, in the strong sense of the term, he can no more decide whether his aspirations could be fulfilled than he can swim before getting wet. (shrink)

In this paper I aim to show that the issue of the constitution of time in Husserl’s thought can not be fully exhausted by a descriptive analysis of the immanent level of consciousness and it rather asks for a deeper search at a pre-immanent (and pre-subjective) level. The way Husserl developes his interpretation regarding the constitution of time leads the descriptive (phenomenological) method to an impasse. Because of this, the Husserlian analysis proceeds to some techniques which bear on what some (...) commentators called a constructive phenomenology. The central point that I argue for in this study is that the premise from which Husserl starts his examination of the constitution of time is ab initio problematic or debatable: that is, consciousness forms the origin of time and one could reach this source by following the path oppened by descriptive analysis. I will hold that time rather originates in the encounter between consciousness and objects or between consciousness and other consciousness (i.e. founded/originated in a relation). (shrink)

In an earlier paper the authors discussed some super-tasks by means of a kinematical interpretation. In the present paper we show a semi-formal way that a more abstract treatment is possible. The core idea of our approach is simple: if a super-task can be considered as a union of (finite) tasks, it is natural to define the effect of the super-task as the union of the effects of the finite tasks it consists of. We show that this approach enables us (...) to handle two of the three super-tasks that we discussed earlier. We also argue that recent objections against our original kinematical interpretation do not hold water. One of our arguments is based on the construction of an elegant correspondence between the first of those three super-tasks and Zeno's Achilles and the Tortois. (shrink)

The writings of John Paul II are rich in meanings and analogies that enrich our understanding of human person and God. According to the tradition, what is specific to human person is reason, which means the ability to assume responsibility. Nevertheless, such responsibility is paradoxical, because it is only realized in relationship with events that depend on circumstances - which are manifested especially in relationships with others, specifically through love. We proved in the first part [1] that plane geometry over Pythagorean fields is axiomatizable by quantifier-free axioms in a language with three individual constants, one binary and three ternary operation symbols. In this paper we prove that two of these operation symbols are superfluous.

O artigo recorda as linhas fundamentais das mudanças produzidas pelo Vaticano II, dentre outras: a recuperação da eclesiologia de comunhão, típica do primeiro milênio da história da Igreja; a afirmação de uma eclesiologia orientada ao Reino; o surgimento de uma igreja que passa a se autocompreender como sacramento de salvação, servidora, caminhante, comprometida com os pobres. Em contraposição a esses avanços, o artigo refere-se às lacunas e sombras que envolvem o Vaticano II: a dualidade entre a afirmação de uma Igreja (...) povo-de-Deus e o acento jurídico da eclesiologia tradicional; o silêncio sobre temas candentes como o celibato sacerdotal e a ordenação de mulheres; a falta de mediações eclesiais para efetivar as propostas do Concílio. Destaca especialmente alguns episódios de “inverno eclesial”, posteriores ao Concílio, protagonizados por setores conservadores da Igreja, de fechamento e resistência às propostas do Vaticano II. Frente à “volta à grande disciplina” que caracteriza o atual momento do Igreja – e considerando o Concílio um divisor de águas em sua história, uma autêntica irrupção do Espírito sobre a Igreja –, a reflexão postula um novo concílio, um Jerusalém II. For this purpose, three points are highlighted: a) the recuperation of the ecclesiology of communion, typical of the first millennium of the history of the Church; b) the affirmation of an orientated ecclesiology to the Kingdom; c) the development of a new conception of church that starts to understand itself as sacrament of salvation, always committed to the poor. On the other hand, the article refers to the gaps and shadows that comprise the Vatican II: a) the dualism between the affirmation of a ´Church People of God` and the emphasis in the legal dimension of the traditional ecclesiology; b) the silence of the Church on relevant subjects such as the sacerdotal celibacy and the women's ordering; d) the lack of ecclesial mediations to bring the proposals of the council into effect. The article stands out the spirit of resistance and of closure of the conservative sectors of the Church to the proposals of Vatican II. Facing the “return to the great discipline” that have characterized the current moment of Church and taking the Council as a basic landmark in its history, and as an authentic outbreak of the Spirit on the Church, the article postulates a new council, a Jerusalem II. When the elder Dionysius died, Dion, a devotee of philosophy, apparently contrived for the old man's son, namesake, and successor to invite Plato back, believing that the young tyrant could be philosophically educated and convinced to lay down tyranny in favor of a new regime based on the rule of law. The plan was defeated, however, by a combination of Dionysius's dissolute life and opposition by Dion's enemies at court. Dion was exiled, and Plato returned to the Academy. Dion implored Plato to return to Syracuse on the basis of reports of Dionysius II's renewed resolution to take up philosophy and by the tyrant himself (who seems to have made some thinly veiled threats against the still-exiled Dion). Plato's second visit to Dionysius was no more successful than the first, however, and he considered himself fortunate to have escaped with his life. Bradley LewisThe name Syracuse has come to stand as an emblem of the problematic relationship between philosophy and politics. While the sources1 differ on specifics, we can be confident that Plato visited there at least three times between 387 and 362 B.C. On his first trip, during the reign of Dionysius I, he became acquainted with Dion, the tyrant's brother-in-law. (...) When the elder Dionysius died, Dion, a devotee of philosophy, apparently contrived for the old man's son, namesake, and successor to invite Plato back, believing that the young tyrant could be philosophically educated and convinced to lay down tyranny in favor of a new regime based on the rule of law. The plan was defeated, however, by a combination of Dionysius's dissolute life and opposition by Dion's enemies at court. Dion was exiled, and Plato returned to the Academy. Dion implored Plato to return to Syracuse on the basis of reports of Dionysius II's renewed resolution to take up philosophy and by the tyrant himself (who seems to have made some thinly veiled threats against the still-exiled Dion). Plato's second visit to Dionysius was no more successful than the first, however, and he considered himself fortunate to have escaped with his life. After a meeting at which Plato recounted the events of his final trip, Dion marshaled an expeditionary force, which included volunteers from the Academy, and set out to expel Dionysius II by violence. The effort succeeded, but the new regime was itself riven by faction, and Dion was assassinated in 353.2The principal legacy of this ill-starred episode is contained in the letters that have come down to us under the name of Plato, particularly those numbered seven and eight. Scholarly discussion of Plato's Seventh Letter has usually focused on three questions: the doctrinal content of the letter and its relationship to the doctrinal content of the dialogues; the character of the letter as an apologia for Plato's Syracusan activities; and the general authenticity of the letter. While the second of these questions focuses correctly [End Page 23] on the rhetorical character of the letter, it ignores the most obvious aspect, namely, the letter's explicit addressees: the friends and comrades of Dion, and their request for political advice. If we take this rhetorical element with sufficient seriousness, we will see that the content of the letter is fully consistent with the teachings of the political dialogues, a point that tells in favor of the authenticity of the letter. Specifically, a focus on the rhetorical character of the letter reveals that its content is determined mostly by what emerges as an effort by Plato to influence his correspondents by moderating their understandable desire for vengeance and thus to forestall further bloodshed and disorder in Syracuse. What is most important about the letter, then, is not so much its account of Plato's actions in Syracuse, but its unveiling of his intentions with respect to Dion's followers. It is not the philosophical-political blueprint, sketched vaguely in the Seventh Letter, that is most important,3 but the concrete effort to mitigate the passions of his correspondents. Read in this light, the letter becomes even more important, since it contradicts the popular image of Plato as a proponent of dangerous political utopianism and portrays a more subtle relationship between philosophy and politics.1. The aim of this paper is to study an early Spanish translation of Utopia that has not received much scholarly attention. We are referring to the manuscript II/1087 of the Real Biblioteca de Palacio, an anonymous text without explicit date that is still unpublished although it is most probably the first complete rendering into a vernacular language of Thomas More's work. We cast light on the date of composition of the manuscript as well as the Latin text used by the (...) anonymous translator. We also analyse the circumstances involved in the making of the text and we ponder the fidelity of the translation and the quality of the Spanish version by comparing it with the Latin text of Utopia. Finally, we draw some conclusions about the anonymous translator. (shrink)

In a neglected passage, Aristotle affirms that certain action-types and emotions – for example, murder, and shamelessness – 'have names that imply badness’ and are categorically prohibited ( EN II.6 1107a8–15). Two questions are of interest. First, on Aristotle’s view, why are these act-types and emotions always vicious? Whether giving little money or feeling anger are vicious is context sensitive. Why aren’t murder and its ilk like that? Second, why are the prohibitions absolute? Why shouldn’t, say, the prospect of avoiding (...) disaster justify them, even if vicious? Intentionally apologetic in tone, the argument moves from old-school Evangelical kinds of defenses that characterized early 1970s apologetic revivals by thinkers like Josh McDowell and his "evidences demanding a verdict" or Francis Schaeffer's The God Who Is There and Escape from Reason. Greenway, however, incrementally shifts from defense language to affirmation of the face, agape, and the gift. He discloses a philosophical spirituality embodied in Christian belief in the ethical realities of freedom, obligations, justice, and love.The book illustrates how these spiritual realities feed back into Christian substantive beliefs through expositions of scripture and doctrine, especially the parables and life of Jesus. The paper examines Robert Filmer’s arguments in defence of the divine right of kings in Patriarcha, or The Natural Power of Kings. Filmer argues that human beings are not born free by nature and, as a result, are expected to obey the kings/monarchs absolutely with­out questioning, due to the arbitrary power and the divine right bestowed upon the kings. This position defended by Filmer is antithetical to the notion of natural freedom of mankind defended by John Locke and other social (...) contract theorists. Contrary to Filmer’s view, this paper suggests that Filmer exaggerated the power of kings. In this paper, I wish to critically examine Filmer’s arguments with which he supported his claim. The paper argues against Filmer’s divine right monarchy for the following reasons: (i) it lacks rational justification, (ii) it was founded on misinterpretation of the scriptures, and (iii) it fails to address the athe­ists’ question. In the final analysis, the paper concludes with the argument that the question of mutual exclusivity of the concepts in the discussion rests upon manifest misinterpreta­tions of divine right and the natural freedom of mankind. Cross-national studies of business-related ethicality frequently have concluded that Americans possess higher ethical standards than non-Americans. These conclusions have generally been based on survey responses of relatively small convenience samples of individuals in a very limited number of countries. This article reports a study of the relationship between nationality and business-related ethicality based on survey responses from more than 6300 business students attending 120 colleges and universities in 36 countries. Two well-documented determinants of business ethics (gender and religiosity) were investigated (...) as moderators of the nationality–business ethicality relationship. The major research finding is that, while statistically significant differences were found between the business-related ethicality of American survey participants and the business-related ethicality of the non-American survey participants, the magnitudes of the differences were not substantial. The results of the study suggest that (i) more empirical cross-cultural/national research is required on business-related ethicality and (ii) previous explanations for cross-cultural/national differences in ethics need to be reconsidered before further generalizations are warranted. Taking a Harder Line “The New Atheism” is the name that was attached, often pejoratively, to the series of six bestselling books by five authors that appeared in the period 2004-2008.[i] Since then many have joined the movement, with an upsurge in books, freethinker organizations, and an exponential expansion of the blogosphere spreading the word on atheism to thousands. The message of new atheism is that it is time to take a far less accommodating attitude toward religion, including moderate religion, (...) than had been exhibited in previous years by atheist authors and, in particular, non-believing scientists. Science, in the United States, is locked in a battle with conservative Christians over the teaching of evolution and creationism in the schools. While 87 percent of scientists accept evolution by unguided, purely natural processes, only 32 percent of the public does.[ii] Belief in unguided evolution among mainline Protestants and Catholics is about the same as among the general public, while only 10 percent of Evangelicals and 19 percent of Fundamentalist Protestants acknowledge this view. This book offers new essays exploring concepts and applications of nonideal theory in bioethics. Nonideal theory refers to an analytic approach to moral and political philosophy (especially in relation to justice), according to which we should not assume that there will be perfect compliance with principles, that there will be favorable circumstances for just institutions and right action, or that reasoners are capable of being impartial. Nonideal theory takes the world as it actually is, in all of its imperfections. Bioethicists (...) have called for greater attention to how nonideal theory can serve as a guide in the messy realities they face daily. Although many bioethicists implicitly assume nonideal theory in their work, there is the need for more explicit engagement with this theoretical outlook. A nonideal approach to bioethics would start by examining the sociopolitical realities of healthcare and the embeddedness of moral actors in those realities. How are bioethicists to navigate systemic injustices when completing research, giving guidance for patient care, and contributing to medical and public health policies? When there are no good options and when moral agents are enmeshed in their sociopolitical viewpoints, how should moral theorizing proceed? What do bioethical issues and principles look like from the perspective of historically marginalized persons? These are just a few of the questions that motivate nonideal theory within bioethics. This book begins in Part I with an overview of the foundational tenets of nonideal theory, what nonideal theory can offer bioethics, and why it may be preferable to ideal theory in addressing moral dilemmas in the clinic and beyond. In Part II, authors discuss applications of nonideal theory in many areas of bioethics, including reflections on environmental harms, racism and minority health, healthcare injustices during incarceration and detention, and other vulnerabilities experienced by patients from clinical and public health perspectives. O objeto da discussão se propõe a buscar na origem do pensamento conservador do XIX e na sua relação com a teologia neoescolástica à chave interpretativa da renovação eclesial e teológica proporcionada pelo Concilio Vaticano II. A vinculação entre teologia e dogmática católica e sua relação com o pensamento conservador pretendem assegurar o retorno a um ideal da cristandade através de uma oposição cerrada com uma filosofia combativa e uma teologia dogmática “antimodernista”. Por um lado, o pensamento conservador alcança seu (...) declínio e permanece a margem diante do surgimento do novo proporcionado pelo Concilio e por outro lado, a desconexão da teologia de toda a cristandade, permite uma renovação da metodologia dogmática católica. O presente texto é um esforço de reunir, em torno do conceito de necropolítica, questões que atravessam a obra de Achille Mbembe e estão ausentes ou são pouco trabalhadas no texto “Necropolítica”. O foco será especialmente em distinguir o poder de matar do necropoder, mostrando como este produz uma espacialidade e um espaço onde ele pode circular livremente, destruindo e constituindo realidades e mundos de morte, articulando os elementos que compõem a necropolítica como formação de terror inaugurada na guerra colonial: (...) i) o exercício do poder soberano como poder de matar e transgredir qualquer normatividade para além de si; ii) a normalização do estado de exceção pelo enquadramento de partes do corpo social como inimigas para além das fronteiras da civilização; iii) a militarização do cotidiano e submissão de zonas sitiadas a uma lógica de guerra sem lei. Essa articulação será analisada em termos de sua instrumentalidade e de seu poder de reencenação infinita em variados contextos após o fim da colônia, levando em consideração o papel fundamental da raça na mobilização desses recursos de guerra e morte. Por fim, a ideia é trazer a necropolítica para o centro do dilema ético maior da obra de Mbembe: a demanda pela derrubada violenta da realidade pós-colonial e o risco da circulação infinita da morte na forma do fratricídio. In international commodity transactions, intermediary certifiers of quantity and quality play a crucial role. Sometimes they err, and when they do, the aggrieved party can pursue remedies against the counterparty or against the intermediary, either in contract or tort. The remedy against the intermediary has depended, at least in part, on whether the plaintiff was in privity. Even absent privity, the aggrieved party could possibly recover in tort. So held Cardozo in the leading New York case Glanzer v. Shepard. Section (...) I of this paper reviews the Glanzer litigation, with special emphasis on how the court suppressed many of the significant facts. Section II then turns to restitution by the principals. Section III explores the courts’ general hostility to intermediaries’ attempts to limit their liability by contract, and Section IV considers the judiciary’s sporadic efforts to place extra-contractual limits on intermediaries’ liability.
